Reduce Your Risk Of A Lawsuit
Notaries are likely to be subject to lawsuits due to improperly notarized documents and other notarial mistakes. To help notaries avoid mistakes and protect themselves, the National Notary Association (NNA) has created a web page offering tips and advice on how to prevent lawsuits.
The NNA's Notary Lawsuit Protection Web Page includes videos about steps notaries can take to prevent legal claims and what notaries should do if they are sued, a PDF document to download, print and use as reference, and links to more information on the topic.

Notary Knowledge Public Awareness Campaign
The National Notary Association has launched its Notary Knowledge public awareness campaign. It features video excerpts and resources to educate the public on what Notaries do, how they protect the public, and what can happen when they are not involved in a transaction. Notary Knowledge outlines several topics that may be unfamiliar to the public, but essential to understanding the role notaries play in the economy and consumer confidence.

Notaries Public Required To Be Fingerprinted for Each Commisson Term
In order to be granted commission as notary public, applicants are required to complete a Department of Justice (DOJ) and Federal Bureau of Investigation (FBI) background check and be fingerprinted via Live Scan. Applicants must first take and pass the notary public exam, and then have their fingerprints taken within one year of the exam date in order to avoid being retested.
Notaries Public who renew their commission need to have their fingerprints taken via Live Scan and pass a background check for each commission term, even if they have been fingerprinted in the past.
All States Notary, Inc. provides Live Scan Fingerprinting Services. For more information please go to Live Scan LA.

The National Notary Association Recommended Notary Practices
Notaries Public are Public Officials bound by the laws of their State and not by anyone else, including an employer, friend, associate or family member.
The National Notary Association has published a list of recommended notary practices:
- Always follow state law that requires the signer to be in your physical presence every time you notarize without exception.
- Always have the signature on the document affixed or acknowledged in your presence.
- Always obtain identification that contains a photograph, physical description and signature.
- Always keep a chronological record of the notarial act, including the signature of the signer in your journal, which must be kept in your custody and control at all times.
- Always ask for a thumbprint of the signer in your journal to help protect against imposture.
- Always confirm that the signer is not being coerced and is willingly signing the documents you notarize.
- Always attach a Notary certificate if wording is not already printed on the document.
- Always notarize only documents that are complete and without blank spaces.
- Always use a seal when you notarize, and be sure to keep it in your custody and control at all times.
- Always refrain from giving advice to signers unless you have the professional training and credentials to do so.
